2. Eligibility
To use our rental services, you must:
- Be at least 21 years old (or as specified in the rental requirements).
- Hold a valid driver’s license recognized in Sint Maarten.
- Provide valid identification and payment information.
- Meet additional eligibility criteria as required for specific vehicles.
3. Booking and Payments
a. Booking
- All bookings are subject to vehicle availability.
- You are responsible for ensuring that all information provided during booking is accurate.
b. Payment
- Payment must be made at the time of booking unless otherwise specified.
- We accept major credit cards and other payment methods specified on our website.
- Any additional charges (e.g., late returns, damages) will be billed to the payment method on file.
4. Cancellations and Refunds
a. Cancellations
- Cancellations made at least 48 hours before the booking start time may be eligible for a full refund.
- Cancellations made within 48 hours of the booking start time may incur a cancellation fee.
b. Refunds
- Refunds will be processed within 7-10 business days.
- Refunds for unused rental periods are not guaranteed and are at our discretion.
5. Use of Rental Vehicles
When using our rental vehicles, you agree to:
- Drive responsibly and comply with all local traffic laws.
- Not use the vehicle for illegal activities or in unauthorized areas.
- Return the vehicle on time and in the same condition as it was rented.
Failure to adhere to these conditions may result in additional charges, suspension of services, or legal action.
6. Insurance and Liability
a. Insurance
- Basic insurance is included with all rentals. Additional coverage options may be available for purchase.
b. Liability
- Renters are responsible for any damages, fines, or penalties incurred during the rental period.
- Renters may be held liable for damages exceeding the coverage provided by insurance.
7. Prohibited Activities
You are prohibited from:
- Subleasing or transferring the rental vehicle to another party.
- Tampering with or modifying the vehicle.
- Using the vehicle for racing, towing, or other prohibited activities.
8. Limitation of Liability
To the maximum extent permitted by law, Cars on the Go SXM is not liable for:
- Indirect, incidental, or consequential damages.
- Loss of personal belongings left in rental vehicles.
9. Termination of Services
We reserve the right to terminate or suspend your access to our services for any violation of these Terms or misuse of our vehicles.
10. Changes to Terms and Conditions
We may update these Terms from time to time. Any changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of Sint Maarten. Any disputes arising under these Terms shall be resolved exclusively in the courts of Sint Maarten.
